These Terms of Service ("Terms") govern your access to and use of the JoinDevs platform at https://joindevs.com ("Platform"), including all services, features, and content provided by JoinDevs ("we," "us," or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. DESCRIPTION OF SERVICE

JoinDevs is an AI-powered job board that connects software developers with employers. Our Platform provides:

For Job Seekers:
• Job search with AI-powered matching and ranking
• AI-tailored resume and cover letter generation
• One-click application flow
• Saved searches and favorite jobs with email alerts
• Interview feedback and rating system for companies
• Professional profile and reputation badges

For Employers:
• Job posting with AI-assisted job description wizard
• Applicant review dashboard with AI candidate summaries
• Flexible pricing tiers (single ads, bundles, featured listings)
• Bidirectional interview feedback system
• Application tracking and analytics
• Company profile with public ratings

2. ELIGIBILITY

You must be at least 16 years old to use the Platform. By using the Platform, you represent and warrant that:
• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information
• You will not use the Platform for any illegal or unauthorized purpose

3. ACCOUNT REGISTRATION

3.1 Creating an Account
• You must register for an account to access certain Platform features
• You can register using your email address or through third-party authentication (e.g., Google)
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Types
• Job Seeker Accounts: For individuals seeking employment opportunities
• Employer Accounts: For companies posting job listings and reviewing candidates
• Users may have both account types but must clearly indicate which role they are using

3.3 Account Security
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage resulting from your failure to protect your account
• You may not share your account with others or allow others to access your account

4. USER CONDUCT

4.1 Prohibited Activities

You agree NOT to:
• Post false, misleading, or fraudulent information
• Impersonate another person or entity
• Post job listings that are discriminatory, illegal, or violate employment laws
• Submit fake reviews or manipulate ratings
• Use automated systems (bots, scrapers) to access the Platform without permission
• Attempt to bypass security measures or access unauthorized areas
• Upload viruses, malware, or other harmful code
• Harass, abuse, threaten, or discriminate against other users
• Post content that is defamatory, obscene, or infringes on intellectual property rights
• Use the Platform for any illegal purpose

4.2 Content Standards

All content you post must:
• Be accurate and truthful
• Not violate any laws or regulations
• Not contain personally identifiable information of others without consent
• Not contain spam, promotional material, or unauthorized advertising
• Comply with our Community Guidelines and AI content moderation policies

5. JOB POSTINGS AND APPLICATIONS

5.1 Job Postings (For Employers)

• Employers must purchase a job posting package to list positions
• Job listings must be for legitimate employment opportunities
• Employers must not discriminate based on protected characteristics
• Job descriptions must accurately represent the position
• Employers are responsible for compliance with all applicable employment laws
• Featured listings receive priority placement but do not guarantee candidates

5.2 Job Applications (For Job Seekers)

• Applications must be truthful and accurately represent your qualifications
• You retain ownership of your resume and application materials
• By applying, you authorize us to share your application with the employer
• Employers make final hiring decisions; JoinDevs does not guarantee employment
• AI-tailored resumes are suggestions; you must review and approve before submitting

6. AI-POWERED FEATURES

6.1 AI Job Matching
• Match scores are estimates based on algorithms and not guarantees
• Scores should be used as guidance, not as the sole decision-making factor
• We continuously improve our algorithms but cannot guarantee perfect accuracy

6.2 AI Resume Tailoring
• AI-generated resume suggestions are provided "as is"
• You are responsible for reviewing and approving all AI-tailored content
• We are not liable for any consequences of using AI-generated content
• You retain full ownership of your original and tailored resume content

6.3 AI Job Description Generation
• AI-generated job descriptions are suggestions and must be reviewed by employers
• Employers are responsible for ensuring job postings comply with all laws
• We provide bias checking as a courtesy but cannot guarantee elimination of all bias

6.4 AI Content Moderation
• We use AI to detect toxic, abusive, or inappropriate content
• Content flagged by AI may be removed or restricted
• You may appeal content moderation decisions by contacting support

7. BIDIRECTIONAL FEEDBACK AND RATINGS

7.1 Candidate Reviews of Companies
• You may rate and review companies after completing interviews
• Reviews can be submitted anonymously or with your name
• Reviews must be based on actual interview experiences
• Reviews must not contain false, defamatory, or abusive content
• Company ratings become visible after reaching a minimum review threshold

7.2 Company Reviews of Candidates
• Employers may provide feedback on candidates after interviews
• Candidate feedback is private and visible only to the candidate
• Feedback must be constructive, professional, and non-discriminatory

7.3 Review Integrity
• Fake reviews, review manipulation, or incentivized reviews are prohibited
• We reserve the right to remove reviews that violate our policies
• Users who consistently post abusive reviews may have their accounts suspended

8. PAYMENT AND PRICING

8.1 Job Posting Fees

Employers must pay for job postings according to our pricing tiers:
• Single job ads: Post individual positions
• Bulk bundles: Discounted packages for multiple postings
• Featured listings: Premium placement with enhanced visibility

8.2 Payment Processing
• Payments are processed securely through Stripe
• All fees are stated clearly before purchase
• Prices are subject to change with notice to existing customers

8.3 Refund Policy
• Job posting fees are generally non-refundable once the listing is published
• Refunds may be granted at our discretion if the listing was not published due to a technical error
• To request a refund, contact bartzalewskidev@gmail.com within 7 days of purchase
• Refunds are processed through the original payment method within 10 business days

8.4 Billing Disputes
• If you believe you were charged in error, contact us within 60 days
• We will investigate and resolve billing disputes in good faith

9. INTELLECTUAL PROPERTY

9.1 Platform Ownership
• JoinDevs owns all rights, title, and interest in the Platform, including design, code, logos, trademarks, and AI algorithms
• You may not copy, modify, distribute, or create derivative works of the Platform without permission

9.2 User Content
• You retain ownership of content you submit (resumes, reviews, job descriptions)
• By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for Platform operation and improvement
• You represent that you have the right to grant this license

9.3 AI-Generated Content
• Content generated by our AI features is provided for your use
• You may use AI-generated content for your employment search or hiring process
• We retain the right to use aggregated, anonymized data for AI improvement

10. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy at https://joindevs.com/privacy-policy, which is incorporated into these Terms by reference.

• We use AI to process your data for matching, tailoring, and moderation
• We share data with service providers (Stripe, Resend, UploadThing, AI providers)
• You have rights to access, correct, and delete your data

11. THIRD-PARTY SERVICES

The Platform integrates with third-party services:
• Stripe (payment processing)
• Resend (email delivery)
• UploadThing (file storage)
• Anthropic and Google (AI services)
• PostHog (analytics)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. DISCLAIMERS

12.1 Platform "As Is"
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 No Employment Guarantee
• We do not guarantee that job seekers will find employment
• We do not guarantee that employers will find suitable candidates
• All hiring decisions are made solely by employers

12.3 AI Accuracy
• AI features are tools to assist but may not be perfectly accurate
• We do not guarantee the accuracy of AI-generated content or match scores
• Users should exercise independent judgment

12.4 User-Generated Content
• We do not endorse or verify user-generated content (reviews, profiles, job postings)
• We are not responsible for the accuracy or reliability of user content
• We do not guarantee that job postings are legitimate or accurate

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• JoinDevs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption
• Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless JoinDevs, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Platform
• Any misrepresentation in your profile, resume, or job posting

15. TERMINATION

15.1 Termination by You
• You may delete your account at any time through account settings
• Deleting your account does not automatically delete all your data (see our Privacy Policy)

15.2 Termination by Us
We may suspend or terminate your account if:
• You violate these Terms
• You engage in fraudulent or illegal activity
• You abuse the Platform or harass other users
• We are required to do so by law
• We cease operations

15.3 Effect of Termination
• Upon termination, your right to use the Platform ceases immediately
• Provisions of these Terms that should survive termination will remain in effect (e.g., disclaimers, limitation of liability, indemnification)
• We may delete your data in accordance with our Privacy Policy

16. DISPUTE RESOLUTION

16.1 Informal Resolution

16.2 Governing Law

18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

18.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

Section headings are for convenience only and do not affect the interpretation of these Terms.
